Terms of Use

1The provider

These Terms apply together with the public Rules. Where the Rules and these Terms conflict, these Terms prevail.

2Definitions

• —User — the individual or legal entity using the Platform.
• —Listing — the board entry made of the link the User supplied and the public data attached to it.
• —Rank (place) — the listing's position, set by the amount paid.
• —Service — showing a listing at a given place on the board, that is, paid advertising placement.

3Subject of the offer

3.1. The Platform lets the User place their site or profile on a public leaderboard. Position is set solely by the amount paid.

3.2. Listings are paid advertising. They are not a recommendation, an editorial assessment, a certificate or an independent ranking by the Platform. The Platform does not verify or guarantee the listed site, its owner, its product, its price or the truth of its claims.

3.3. Payment gives the User the rank the amount reaches at the moment the payment is confirmed. It does not guarantee: visitor traffic, click counts, customers, revenue, holding a rank for any period, exclusivity, or search-engine results.

3.4. Another User may rise above you by paying more.

3.5. The Platform may change, suspend or discontinue the ranking formula, minimum amounts, categories and features.

4Charitable commitment

4.1. The Platform does not operate for commercial profit. Money received for listings is directed to paying the tuition contracts of students in need.

4.2. After payment-system fees and taxes required by law are deducted, 100% of what remains is spent on that purpose.

4.3. Funds are transferred directly to the bank account of the higher-education institution.

4.4. The Platform publishes a public quarterly report of money collected and money spent.

4.5. A User's payment is not a charitable donation; it is a fee for an advertising service. The charitable relationship is between the Platform and the institution, and the User is not a party to it.

4.6. Whether any particular student's contract was paid does not affect the User's rights against the Platform and is not a ground for a refund.

5Requirements for the User

5.1. The User must be at least 18 years old and legally capable of entering a contract.

5.2. Acting for a legal entity, you confirm that you are authorised to bind it.

5.3. The User must not use the Platform contrary to the law of the Republic of Uzbekistan, nor to the law of their own country of residence.

6Warranties about the listing

By submitting a link or a payment the User warrants that:

• —they are entitled to direct visitors to the address given;
• —the listing and the address comply with applicable law, including on advertising, consumer rights, personal data and intellectual property;
• —they are not acting on behalf of another person, brand or company, and are not listing a competitor's site without permission;
• —the address is not malware, phishing or a fraudulent site;
• —the information provided is correct and current.

7Prohibited content

The restrictions listed in section 2 of the Rules form an integral part of these Terms. In addition, the Platform may not be used for: artificially inflating click counts, circumventing rate limits, unauthorised automated payments, scraping the site beyond ordinary use, or reverse engineering.

8Payment, price and taxes

8.1. Prices are shown in Uzbek soum and appear on screen before payment.

8.2. Payments run through Click. The Platform does not collect or store payment card details — the payment provider handles them, and its own terms also apply.

8.3. Completing the payment flow is an offer to buy the listing service on these Terms. The contract is formed when the payment is confirmed and the listing is written to the board.

8.4. Taxes required by law are included in the price.

8.5. Raising a rank charges only the difference between the current and the new amount.

9Refunds

9.1. A listing is a digital service delivered immediately. As soon as payment is confirmed the listing is created or the amount raised, and it appears on the public board. By paying, the User agrees to immediate performance.

9.2. Once performed, the payment is not refundable. In particular these are not grounds for a refund: another User later paying more; fewer clicks than hoped for; disagreement with the category; brief unavailability of the site; removal of the listing for breaching the Terms.

9.3. If the service was not delivered for a technical reason or through the Platform's fault (payment taken, listing not created), the payment is refunded in full or the listing is recreated — at the User's choice. Contact: info@tp.uz.

9.4. Rights given to consumers by the Law of the Republic of Uzbekistan “On Protection of Consumer Rights” that cannot be limited by contract are preserved.

9.5. A chargeback without lawful grounds is a breach of these Terms. The listing is then removed and further use of the Platform may be refused.

10Right to remove a listing

10.1. The Platform may without prior notice refuse, delay, edit, recategorise, hide or remove any listing or payment, including where:

• —there is reason to consider these Terms, the Rules or the law breached;
• —a complaint arrives from a rights holder or a third-party platform;
• —the listing creates legal, security or reputational risk for the Platform.

10.2. In that case the money paid is not refunded, as it may already have been directed to the charitable purpose.

11Intellectual property

11.1. The Platform may automatically fetch and display public data about listed addresses (name, title, description, logo, favicon, Open Graph image, profile name and avatar). This data is used only to identify the listing and implies no partnership with, or approval by, the rights holder.

11.2. The User grants the Platform a non-exclusive, worldwide, royalty-free licence to place, store, copy, adapt for format and publicly display the listing and its public data within the Platform's activity.

11.3. The tp.uz name, logo and site design belong to the Platform. Copying or scraping the leaderboard for a competing product is prohibited.

11.4. A rights complaint goes to info@tp.uz and must include: the complainant's name and contact details; the link to the listing on tp.uz; the link to the address; a description of the problem; a statement that the information is accurate and that the complainant is the rights holder or their representative.

12No warranties

The Platform is provided “as is”. Uninterrupted, error-free or secure operation is not guaranteed. The accuracy or completeness of listings, names, images, ranks and click statistics is not guaranteed.

Appearing on the board is not the Platform's opinion of a product. Click and visitor statistics are what the system recorded, not a promise that you will see the same.

13Limitation of liability

13.1. Liability that cannot be limited by law is not limited.

13.2. Beyond that, the Platform is not liable for lost profit, lost data, reputational harm or other indirect loss.

13.3. The Platform's total liability on one claim is limited to the amount the User paid for the listing the claim concerns.

13.4. Links on the Platform lead to external sites. The Platform is not responsible for their content, terms or practices.

14Indemnity

The User indemnifies the Platform against third-party claims, losses and reasonable legal costs arising from their listing, the linked site, their payment, or their breach of these Terms.

15Dispute resolution

15.1. Disputes are first pursued through a pre-court claim. A claim is sent to info@tp.uz and is considered within 15 days.

15.2. Failing agreement, the dispute is heard by the court at the provider's location under the law of the Republic of Uzbekistan. Consumers keep the statutory right to choose the court.

16Changes to these Terms

The Platform may change these Terms. On a material change the date at the top of the page is updated. Continuing to use the Platform after a change means accepting the new Terms. A payment already made is governed by the Terms in force when it was made.

17Final provisions

• —If any clause is held invalid, the remaining clauses stay in force.
• —The Platform not enforcing a clause does not waive it.
• —These Terms, the Rules, the Privacy Policy and the data confirmed at payment together form the entire agreement between the parties.
• —Payment, hosting and analytics run through third-party services; their outages are outside the Platform's control.
